Bringing counterintelligence and law enforcement perspectives, Kealiher Mitigation Advisory (KMA) provides national security advisory services focused on foreign direct investment (FDI) screening.

KMA advises United States government agencies, foreign governments, and private-sector clients across the full lifecycle of FDI review under the Committee on Foreign Investment in the United States (CFIUS) and analogous foreign screening regimes:

  • Pre-deal diligence and risk identification

  • Filing preparation and voluntary disclosure strategy

  • Pending review support and government interface

  • Mitigation negotiation and agreement drafting

  • Security policy construction and least-burdensome implementation

  • Post-clearance compliance and in-house training

  • Tabletop exercises

Beyond CFIUS, KMA has worked with the U.S. government to assist foreign governments in designing and implementing indigenous FDI screening frameworks. KMA’s foreign assistance includes hypothetical screening architectures, executive- and operational-level training, sector-specific national security risk mapping, and advisory support to law enforcement and intelligence communities. Any foreign government engagements with KMA will be coordinated with the U.S. government.

KMA is designed to complement a client’s legal counsel. Engagement with KMA prior to retaining legal representation can optimize client decisions on counsel selection. Although KMA's founder holds an active bar license, KMA provides national security consultation only; KMA offers no legal services.
